You will be working as EG Electrification Contract Manager and will be the part of Electrification business area for Distribution Solutions division based in Cairo, Egypt. In this role you will be reporting to Sales & Marketing Manager & EL Commercial Leader and will be responsible to lead the provision of contracts and risks management services to the Local Business Unit/Product Group or Country, ensuring all contracts and risks management activities are executed in accordance with Group/Division/Business Unit directives and instructions including Company procedures and the Contract Management Framework

Your responsibilities

  • Ensuring the portfolio of contracts and risks reviews and management in the business follows contract, risk reviews and claims management methodologies in accordance with internal standard procedures, reviewing and commenting on commercial and technical tender risks reviews, terms and conditions
  • Developing contract strategy based on ABB’s policies, customer requirements and the overall execution strategy taking into account risks, pricing, scope, and schedule, identifying the contract baseline (including terms and conditions, specifications, drawings, estimate, proposal, schedule and other documents incorporated in the contract) and highlights areas of potential risk
  • Ensuring timely and accurate execution of commercial aspects in portfolio of contracts (i.e. payments, claims, variation orders, warranties, provisions, guarantees, etc.), verifying that both parties to the contract have fulfilled their contractual obligations and there are no responsibilities outstanding, assessing success of the contract and determines if there are any lessons learned for future contracting
  • Documenting and communicating to all appropriate parties any deficiencies found as part of the closeout process, establishing and enforcing standard change methodologies in portfolio of contracts to identify changes and quantify the additional time and compensation due to ABB per the contract, defines approval requirements and communicates changes to the customer
  • Enforcing and defending ABB's contractual interests against customer and suppliers during the whole of a project life cycle, including monitoring and assessment of changes and deviations, as well as defending and enforcing claims, in concert with Legal, develops the negotiation strategy and supports negotiations, supporting Legal handling formal dispute resolution, litigation and arbitration
  • Notifying and liaises continuously with Legal to report major claims and keeps Legal updated of any critical development during project execution, liaises continuously with Legal to supports drafting of Purchase Orders, Contracts and Subcontracts and ensures that relevant (sub) contracts contain appropriate contract terms to protect ABB’s interest, including flow-down of main contract terms
  • Analyzing prime contract terms to highlight areas of potential opportunity and risk, such as ambiguities, omissions and conflicts, as work proceeds, seeking advice from Legal to draft, negotiating and finalizing agreements during the Sales and Project Execution phases developing and implementing risk mitigation and opportunity plan in concert with Project Manager and/or Sales Manager or FES Manager
  • Seeking advice from Legal (Export Control) and trade compliance officers to ensure accurate handling of all export control matters and ensures close review of all contracts and projects with regard to restrictions on exports, considering countries, customers or products involved and the respective laws and ABB regulations
  • Ensuring (with HR Manager support) that the area of responsibility is organized, staffed, skilled and directed. Guides, motivates and develops direct/indirect subordinates within HR policies, liaise with legal to build up framework agreements to standardize contracts with customers and suppliers

Your background

  • Bachelor’s Degree in engineering or law degree
  • Faculty of law (English/French Section) – Faculty of Engineering with a certified 2 years risks and contracts management certificate from a reputable university
  • Minimum 10+ years of experience in relevant field
  • Perfect user of Microsoft, excel and CRM programs
  • Fluent Arabic & English reading and writing, French is a preference
